This Billing and Cancellation Policy forms part of the OmevAI Terms of Service.
1. Creem is Merchant of Record
OmevAI uses Creem to sell paid Products. Creem acts as Merchant of Record and contractual reseller for the checkout transaction. You pay Creem, receive an invoice from Creem, and use Creem's customer portal to manage the payment method and subscription.
Your payment relationship with Creem is governed by the Creem Buyer Terms and Creem Privacy Notice. If those Buyer Terms conflict with this Policy about checkout, payment, tax, refund or the Creem portal, the Creem Buyer Terms control.
OmevAI remains responsible for delivery, operation and product support. Contact [email protected] first for a product or delivery problem.
2. Product information at checkout
The applicable OmevAI or Creem order page will state the material terms for the Product, which may include:
- one-time or recurring price and currency;
- billing interval;
- included task, token or credit allowance;
- overage or usage-based rate;
- credit activation and expiry period;
- renewal terms; and
- any promotional or Product-specific condition.
The checkout terms accepted for a particular Order form part of the agreement. A general pricing page is informational and may change for future Orders.
3. Subscriptions and automatic renewal
A recurring Product automatically renews for successive billing periods until cancelled. By purchasing it, you authorise Creem to charge the payment method on file for the recurring price and applicable tax on each renewal date.
Cancel before the next renewal charge using the Creem customer portal or another cancellation method expressly offered for your Order. Cancellation takes effect at the end of the current paid period; access and included entitlement continue until then unless the account is suspended for breach, security or law.
Closing an OmevAI account, deleting an API key, removing a partner integration or ceasing use does not by itself cancel a Creem subscription.
4. Prepaid credits, allowances and overage
Prepaid credits and included allowances:
- are usable only for the applicable OmevAI Product and account;
- are not money, stored value or transferable property;
- have no cash value and cannot be withdrawn;
- do not roll over unless the checkout expressly says otherwise; and
- expire at the end of the validity period displayed at purchase.
For a Product displaying a 30-day validity period, unused credits expire 30 calendar days after activation or the applicable cycle start. The checkout controls if a different period is shown.
Usage beyond an included allowance may be rejected, require a top-up or be billed at the overage rate shown for the Product. Metering records generated by OmevAI are authoritative absent a demonstrated error. Report a suspected metering error promptly with the affected account, key alias, time window and request identifiers; never send the full API key.
5. No prorated refunds
Except as stated below:
- subscription charges are not prorated or refunded for an unused part of a billing period;
- prepaid credits and unused allowances are non-refundable;
- expired credits are not reinstated or carried forward; and
- downgrades take effect at the next renewal unless the Order states otherwise.
A refund may be provided where required by mandatory law, required under the Creem Buyer Terms, or approved through Creem for a verified duplicate/incorrect charge or material service failure. All transaction refunds and chargebacks are processed by Creem under its procedures.
Because OmevAI is offered only for business or professional use, consumer cancellation and withdrawal rights are not part of the intended offering. A mandatory non-waivable right remains unaffected if it nevertheless applies.
6. Billing problems and refund requests
For a Product or delivery issue, contact [email protected] before initiating a chargeback. Include the invoice/order identifier and a description, but do not send payment-card details.
For Creem portal, invoice or payment-processing issues, use the support route provided by Creem. Creem exclusively processes any approved transaction refund.
An unauthorised or abusive chargeback, or failure to pay an undisputed amount, may result in suspension and recovery of reasonable costs to the extent permitted by law.
7. Taxes and billing information
Creem calculates, collects and remits applicable VAT, sales tax and other indirect taxes for the checkout transaction. You must provide accurate billing address, business status, tax identifiers and exemption information.
You remain responsible for taxes imposed directly on you, including income, withholding or similar taxes, unless the applicable law requires Creem or OmevAI to collect them.
8. Failed payments
If a charge fails, Creem may retry it or request an updated payment method. OmevAI may restrict or suspend the associated entitlement after notice or when Creem reports that payment is overdue, reversed or fraudulent.
Reactivation may require payment of the outstanding amount and purchase of a new entitlement. OmevAI is not responsible for loss caused by inaccurate billing information or a failure to maintain a valid payment method.
9. Price and Product changes
OmevAI may change prices, allowances, overage rates or credit periods for future Orders. For a materially adverse change to an active recurring Product, OmevAI or Creem will provide at least 30 days' notice where practicable. The new terms apply no earlier than the next renewal after the notice period.
If you do not accept the change, cancel before it takes effect. Continued renewal constitutes acceptance of the updated price and Product terms.
10. Partner-embedded checkout
An Authorised Integration Partner may display an OmevAI connection flow and open Creem checkout. The end customer purchases directly from Creem, accepts OmevAI's Terms and receives a customer-specific OmevAI key.
The partner is not entitled to collect the OmevAI purchase price from the customer or alter Creem's invoice merely because it facilitated the connection. OmevAI may attribute the account and key to the originating partner for internal partner administration without disclosing the partner's commercial terms to the customer.
